Terms of Service

1. The Agreement

These Terms of Service ("Terms") are a binding legal contract between you ("The User" or "Customer") and Tail AI Ltd (doing business as "Axel").

By creating an account, accessing, or using the Axel platform, you agree to be bound by these Terms. If you are entering into this agreement on behalf of a company or other legal entity (such as an agency or ecommerce brand), you represent that you have the authority to bind that entity to these Terms.

2. What Axel Is (And What It Isn't)

Axel is a production tool designed to help you create email assets.

• We are the builder, not the sender. Axel generates HTML and copy, but the actual sending of emails happens via your own platforms (e.g., Klaviyo).
• You are the final editor. Axel uses AI to generate content, but AI can make mistakes. You agree that you are responsible for reviewing, editing, and approving all content before it is sent to your customers.

3. Account Terms

• Security: You are responsible for keeping your login credentials secure. Axel is not liable for any loss or damage from your failure to maintain the security of your account.
• Seats: Your plan includes a specific number of team seats (e.g., 2 seats for Pro). Sharing login credentials with multiple users beyond your seat limit is a violation of these terms.

4. Payment & Cancellation

• Subscription: Axel is a paid subscription service. You will be billed in advance on a recurring and periodic basis (monthly or annually).
• Cancellation: You can cancel your subscription at any time inside your dashboard. Your access will continue until the end of your current billing period.
• Refunds: Aside from the specific "30-Day Money-Back Guarantee" offered to new partners, all other subscription payments are non-refundable unless required by law.

5. Intellectual Property

• Your Content: You own the rights to the data you sync (from Shopify) and the final emails you create. Axel claims no ownership over your brand assets or your customer lists.
• Our IP: Axel retains all rights to the software, the interface, the generative algorithms, the pre-built templates, and the "D2C Strategy Blueprints" provided in the partnership bundle.

6. Acceptable Use (The "No Spam" Rule)

Since Axel produces email content, we have a zero-tolerance policy for abuse. You may not use Axel to:

• Generate spam, phishing content, or misleading scams.
• Create content that promotes violence, hate speech, or illegal activities.
• Violate the Acceptable Use Policies of the platforms you connect to (Shopify or Klaviyo).

If we detect abusive behavior, we reserve the right to terminate your account immediately without refund.

7. Limitations of Liability

• AI Disclaimer: Axel provides tools to assist in creation, but we do not guarantee that the content generated is unique, trademark-free, or factually accurate.
• Revenue Disclaimer: We provide the tools and strategy, but we do not guarantee specific financial results, open rates, or ROAS. Your marketing performance depends on your own execution.
• Third-Party Platforms: Axel relies on connections to Shopify and Klaviyo. We are not responsible for service interruptions, API changes, or data issues caused by these third-party providers.

8. Changes to Terms

We may update these terms as the software evolves. If we make significant changes that affect your rights, we will notify you via email. Continued use of Axel after such changes constitutes acceptance of the new terms.
