- Billing Information: We use Polar as our Merchant of Record. This means Polar handles the payment processing, tax compliance, and invoicing. We do not store your raw credit card numbers.
- Brand Assets: Logos, color codes, tone of voice preferences, and brand guidelines you upload to your Brand Kit.
B. Information We Sync (Integrations)
When you connect Axel to third-party platforms (like Shopify or Klaviyo), we access specific data to generate content and analyze results:
- Shopify Data: Product catalogs, images, descriptions, pricing, collections, and store metadata (e.g., currency, timezone).
- Klaviyo Data: We sync with Klaviyo to:
- Export: Push completed campaigns, flow sequences, and templates directly to your account.
- Analyze: Read performance data (such as open rates, click-through rates, and revenue attribution) from past campaigns. We use this to provide smart suggestions on what content is performing best for your specific audience.
C. Usage Data
- Interaction Data: How you use the editor, the prompts you issue to the AI, and the templates you choose.
- Device Data: IP address, browser type, and device information for security and debugging.
3. How We Use Your Data
We use your data to make the product work and improve your results. We do not sell your data.
- To Provide the Service: Generating email copy, assembling layouts, and exporting HTML to your marketing platform.
- To Improve Performance: Using your Klaviyo analytics to refine the AI's "Smart Suggestions," ensuring future emails are optimized for better conversion.
- To Improve Axel: Analyzing usage patterns to fix bugs and improve the quality of our AI suggestions.
- To Communicate: Sending you transactional emails (via our Merchant of Record, Polar, or directly from us) regarding your subscription and product updates.
- AI Content Generation: We send specific inputs (e.g., your product description and tone of voice) to third-party AI models (LLMs) to generate your email copy. These providers are not permitted to use your private data to train their public models.
4. How We Share Information
We share data only when necessary to run our business or comply with the law.
- Service Providers: We use trusted third-party vendors for hosting (e.g., AWS) and AI generation (e.g., OpenAI/Anthropic). They process data strictly on our instructions.
- Merchant of Record: We share order and customer details with Polar to facilitate payments, handle tax calculations, and issue invoices.
- Legal Obligations: We may disclose information if required by a subpoena, court order, or valid government request.
- Business Transfers: If Tail AI Ltd is acquired or merged, user data may be transferred as part of the business assets.
5. Your Ecommerce Data (The "Processor" Role)
If you are an agency or merchant using Axel to process data regarding your customers (though Axel primarily handles product and design data, not shopper PII), you are the Data Controller and Tail AI Ltd acts as the Data Processor.
We process this data solely to provide the content creation service in accordance with our Terms of Service.
6. International Transfers
Tail AI Ltd is based in the UK. However, our servers and service providers may be located in the United States or other jurisdictions.
When we transfer data outside the UK or EEA, we ensure it is protected by appropriate safeguards, such as:
- Standard Contractual Clauses (SCCs).
- The UK International Data Transfer Agreement (IDTA).
- Adequacy decisions regarding the recipient country.
7. Your Rights
